Intellectual Property Policy

Last updated: March 11, 2025

This Intellectual Property Policy describes how Domain ("we," "us," or "our") manages, protects, and enforces intellectual property rights in connection with the platform and services available at domain.biz. By accessing or using our services, you acknowledge that you have read, understood, and agree to this policy.

1. Ownership of Platform Content

All content, materials, and elements that form part of the Domain platform — including but not limited to course materials, lesson structures, instructional text, graphics, user interface design, software code, databases, trademarks, logos, and audiovisual content — are the exclusive intellectual property of Domain or its duly licensed content partners.

These materials are protected under applicable copyright, trademark, trade secret, and other intellectual property laws. No rights are transferred to users beyond the limited licence expressly granted in these terms.

1.1 Trademarks and Service Marks

The name "Domain," its logo, and any associated product or service names displayed on this platform are trademarks or service marks owned by or licensed to Domain. Unauthorised use of any trademark or service mark associated with Domain is strictly prohibited and may constitute infringement.

1.2 Software and Technology

The underlying software, algorithms, application programming interfaces, and technical infrastructure that power the platform are proprietary to Domain. Reverse engineering, decompiling, disassembling, or otherwise attempting to derive source code from any part of the platform is not permitted.

2. Licence Granted to Users

Subject to your continued compliance with our Terms of Service and this policy, Domain grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use platform content solely for your personal, non-commercial educational purposes.

This licence does not permit you to:

— reproduce, duplicate, copy, or distribute platform content beyond what is necessary for personal learning;

— sell, resell, rent, lease, or otherwise commercially exploit any portion of the platform or its content;

— publicly display or perform any content without prior written authorisation from Domain;

— create derivative works based on platform content without express written permission;

— remove, alter, or obscure any copyright, trademark, or other proprietary notices.

3. User-Submitted Content

3.1 Ownership Retained by Users

You retain ownership of any content you submit, upload, or create on the platform, including written assignments, discussion posts, project files, and other original works ("User Content"). By submitting User Content, you do not transfer ownership to Domain.

3.2 Licence Granted to Domain

By submitting User Content, you grant Domain a worldwide, royalty-free, non-exclusive, sublicensable licence to use, store, reproduce, adapt, and display such content as necessary to operate, improve, and provide the platform and its services. This licence continues for the duration required to fulfil these purposes and terminates upon deletion of the content, subject to operational and backup retention requirements.

3.3 User Representations

You represent and warrant that:

— you own or have obtained all necessary rights and permissions to submit the User Content;

— the User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party;

— the User Content complies with all applicable laws and our platform policies.

4. Prohibited Uses

The following activities are strictly prohibited on the Domain platform:

Prohibited Activity Description
Unauthorised reproduction Copying, recording, screenshotting, or otherwise duplicating course content for distribution outside the platform
Commercial redistribution Selling, licensing, or monetising access to any platform content without written authorisation
Plagiarism Presenting platform content or another user's work as your own in any context
Automated data extraction Using bots, scrapers, crawlers, or automated tools to extract content or data from the platform
Circumvention Bypassing or attempting to bypass any technological protection measure implemented on the platform
Derivative distribution Creating and distributing derivative works based on platform content without express written consent

5. Third-Party Intellectual Property

The platform may incorporate content, tools, or resources owned by third parties, including instructors, content partners, open-source projects, and licensed data providers. Such third-party content remains the intellectual property of its respective owners and is used on the platform under applicable licences or permissions.

Domain does not claim ownership over third-party intellectual property and is not responsible for ensuring users comply with third-party licence terms where those materials are accessed independently.

6. Copyright Infringement — Notice and Takedown

6.1 Reporting Infringement

If you believe that content available on the Domain platform infringes upon your copyright or other intellectual property rights, you may submit a written notice to us. Your notice should include the following information:

— identification of the copyrighted work or intellectual property you claim has been infringed;

— identification of the material on the platform that you claim is infringing, with sufficient detail to allow us to locate it;

— your contact information, including full name, mailing address, telephone number, and email address;

— a statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent, or applicable law;

— a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or are authorised to act on their behalf;

— your physical or electronic signature.

Notices may be submitted to: [email protected]

6.2 Counter-Notice

If you believe that content you submitted was removed or disabled as a result of a mistake or misidentification, you may file a counter-notice. Counter-notices should include equivalent identifying information and a declaration that you consent to the appropriate legal process.

6.3 Repeat Infringers

Domain reserves the right to terminate, at its sole discretion, the accounts of users who are found to be repeat infringers of intellectual property rights.

7. Open-Source Components

Certain components of the Domain platform may be built using open-source software. Where open-source licences apply, the terms of those licences govern use of the respective components. Nothing in this policy is intended to limit rights granted under applicable open-source licences.

8. Confidentiality and Trade Secrets

Certain information relating to Domain's platform, business operations, course methodology, and technology may constitute confidential information or trade secrets. Users who access such information through the platform or through a professional relationship with Domain agree not to disclose, reproduce, or exploit such information without prior written authorisation.

9. Enforcement

Domain actively monitors the platform for intellectual property violations and reserves the right to pursue all available legal remedies in the event of infringement. Remedies may include, without limitation, removal of infringing content, suspension or termination of user accounts, and civil or legal action to the extent permitted by applicable law.

10. Modifications to This Policy

Domain reserves the right to update or modify this Intellectual Property Policy at any time. Material changes will be communicated through appropriate notice on the platform or via the contact information associated with your account. Continued use of the platform following the posting of changes constitutes your acceptance of those changes.
